Terms of Service

1. Agreement to Terms

By accessing or using bludata.ai or engaging BluData AI for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

BluData AI provides done-for-you digital services including workflow automation and CRM setup, AI voice agent deployment, rebranding and logo design, website design and development, and ongoing system management. Specific deliverables and pricing are defined in individual service agreements.

3. Client Responsibilities

Provide accurate and timely information necessary for service delivery
Grant BluData AI access to tools and platforms required to perform agreed services
Review and provide feedback on deliverables within the agreed timeframe
Make payments as outlined in your service agreement
Use our deliverables only for lawful purposes

4. Payment Terms

Payment terms are outlined in your individual service agreement. Invoices are due upon receipt unless otherwise specified. Late payments may incur a fee of 1.5% per month on outstanding balances. All fees are non-refundable unless explicitly stated in your service agreement.

4a. No Refund Policy

All sales are final. BluData AI does not issue refunds under any circumstances once a service agreement has been executed or payment has been received.

This includes, but is not limited to:

Payments made for one-time projects or setup fees
Monthly retainer or subscription payments, including partial billing periods
Payments made prior to project kickoff
Situations where the client changes direction, cancels, or is dissatisfied with work delivered in accordance with the agreed scope

By engaging BluData AI and submitting payment, you acknowledge and agree that all fees paid are non-refundable. If you have concerns about deliverables, please contact us at sales@bludata.ai and we will work in good faith to resolve any issues.

5. Intellectual Property

Upon full payment, all custom deliverables created specifically for you become your property. BluData AI retains ownership of pre-existing tools, templates, and frameworks. You grant BluData AI a non-exclusive license to display completed work in our portfolio unless otherwise agreed in writing.

6. Confidentiality

Both parties agree to keep confidential any proprietary information or business data shared during the engagement. This obligation survives termination of the service relationship.

7. Month-to-Month Services

For ongoing monthly services, either party may terminate with 30 days written notice. BluData AI will complete work in progress through the end of the notice period. No refunds are issued for partially used billing periods.

8. Limitation of Liability

To the maximum extent permitted by law, BluData AI shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the total amount paid by you in the three months preceding any claim.

9. Disclaimer of Warranties

Our services are provided "as is." BluData AI does not guarantee specific business outcomes such as revenue growth or lead volume, as these depend on factors outside our control.

10. Governing Law

These Terms are governed by the laws of the State of Illinois. Any disputes shall be resolved in the courts located in Illinois.

11. Changes to These Terms

BluData AI may update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
